PMR Restrukturyzacje zastąpi spółkę Zimmerman Filipiak Restrukturyzacja, która sama wnioskowała o zmianę zarządcy. The court has appointed an administrator for the sanitation proceedings for the owner of the Dayli drugstore. Now the interim managers are to get to work. Things are not good and the ambiguities are only increasing, but at least the impasse is coming to an end. This is the situation at Kerdos (former Hygienice), the listed operator of the Dayli drugstore chain. On Wednesday, the court appointed an administrator for the sanitation proceedings at the company, which is not paying its debts and is closing shops, but is trying to save itself from liquidation. This was appointed by the law firm PMR Restrukturyzacje, which is also involved in the sanitation proceedings of another listed black sheep, Hawe Telekom of the Hawe Group. - Our role is to efficiently administer the proceedings, the company's operational activities are to be taken care of by interim managers. The key is to raise financing for the company, which can be done in several ways. There is, of course, the sale of assets or the raising of an investor, or in the extreme case the conversion of debt into shares. On 11 May, a hearing will be held before a court in Krakow, at which the administrator of the Kerdos zoning proceedings is to be appointed. This is likely to be PMR Restructuring. The company's main shareholder and Monika Nowakowska, who is cooperating with him, want the same law firm to formally take over as manager also in Dayla and allow the managers pulled in by RDM Partners to operate. This is because Romuald Kalyciok is in conflict with Zimmerman Filipiak Restrukturyzacja, which was appointed administrator of the sanitation proceedings in February. Zarząd Hawe w ciągu najbliższych dni odwoła się od wniosku Agencji Rozwoju Przemysłu (ARP) o ustanowienie zarządcy do wykonywania praw korporacyjnych, podało biuro prasowe Mediatela. W opinii zarządu spółki, wniosek jest nieskuteczny, ponieważ w Hawe od 7 marca br. trwa postępowanie sanacyjne a spółka ma już wyznaczonego zarządcę. Zgodnie z postanowieniem sądu, postępowanie sanacyjne ma charakter postępowania głównego. Oznacza to, że wszelkie roszczenia egzekucyjne zostają wstrzymane do czasu przeprowadzenia restrukturyzacji i zawarcia układu z wierzycielami, którego celem jest spłata zobowiązań” – czytamy w komunikacie. „Obecnie w spółce trwają intensywne prace nad założeniami planu restrukturyzacyjnego. The fibre optic group's share price soared in anticipation of the news. Up to 56 per cent return on investment could be achieved by buying Hawe shares on Wednesday at 73 cents and selling them on Friday morning on the upside at PLN 1.14 apiece. The stock price of the fibre-optic group undergoing court-supervised restructuring rose the most on Thursday - by more than 30 per cent. First, before midnight on Thursday, Hawe reported that the Cypriot vehicle Trinitybay Investments had disposed of all its shares in February (thus there is not a single entity in the shareholding with a 5 per cent stake and votes at the general meeting). A Warsaw court has issued two decisions in quick succession, opening sanction proceedings first at Hawe Telekom, an operating company in the Hawe group that owns the fibre-optic network, and then at the parent company. There are opinions that the content of the court's decision will hinder the smooth restructuring of the group. Hawe Telekom's management believes that this is possible under certain conditions. After the latest court decisions, the restructuring of the Hawe group may be difficult to carry out, point out lawyers, but also creditors of the fibre-optic group. The WSE-listed company first announced a decision by a Warsaw court to open sanctioning proceedings at its subsidiary Hawe Telekom, and on Tuesday a similar decision for the listed company itself.
